Where each Australian jurisdiction stands on residential energy disclosure today.
The Australian Capital Territory (ACT) is currently the only Australian jurisdiction with mandatory disclosure of a home's Energy Efficiency Rating (EER) at the point of sale. Victoria is rolling out Scorecard-based disclosure for rentals and sales, and NSW has flagged it as a future reform.
No — NSW does not currently require energy rating disclosure when selling a home. However a voluntary NatHERS rating is a strong selling point, and Mandatory Disclosure of Residential Energy Performance is on the NSW reform agenda.
Victorian rentals must meet minimum energy efficiency standards under the Residential Tenancies Regulations (e.g. fixed heating in the living area). Scorecard rating disclosure is being phased in for rentals as part of the REED program.
All new homes built under the National Construction Code 2022 must achieve a minimum 7-star NatHERS rating plus a Whole-of-Home energy budget. This applies in every state and territory.
